パートナーのYです。USへのボールペンセットの輸出時に、TSCA（TOXIC SUBSTANCE CONTROL ACT、有害物質規制法）への対応が要求されたという経験をしました。
FedExからの連絡が発端でした。まず初めに、何本セットなのか、素材は何かなどの質問に回答すると、次にBuyerに連絡が取れなくて困っているという以下のメールが来ました。
現在、アメリカにて通関手続き中でございます。
荷受人様より提出いただきたい書類がございますのでアメリカの担当者よりお電話をさせていただきましたが、
出られなかったためメッセージを残させていただいている状況です。もし、荷受人様のEMAILアドレスをご存じでしたら、私までお知らせいただけますでしょうか。
また、荷受人様からもアメリカフェデックスにご連絡いただけますようお伝えいただけますと幸いです。

BuyerのEbay Mail Addressを伝え、こちらからBuyerにも連絡しました。
するとその次に受け取ったのがFedEx からBuyer への以下の依頼でした。これを見て初めて、TSCAフォームが要求されていると知りました。

I am in the process of clearing the shipment associated with the attached invoice, referenced by the tracking number listed above. The shipment has arrived in the US and is currently being held by US Customs pending additional information. In order to clear this shipment through U.S. Customs, we will need more information as designated below:
Please fill out the Toxic Substance Control Act (TSCA) Certification form (please see attachments).
Please see the attached documents for your reference. Before we can submit this shipment to US Customs for clearance we will need to obtain a Toxic Substance Control Act (TSCA) Certification. The form that is needed has been attached to this e-mail and can be returned to me via e-mail when completed. The Federal Express air way bill number is the tracking number in the subject line and the return to is my name.
Please check Positive or Negative Certification, more information can be found at https://www.epa.gov/tsca-import-export-requirements.
Please also complete all data elements below the certification including company name and address, certifier name, title, phone number, email address and signature. As well as a detailed product description including end use.
Who Completes the Documentation?
• Per 19 CFR 12. 121 (a), the importer or their authorized agent must complete the TSCA certification. Shipper is acceptable as an authorized agent only under limited circumstances. If the shipper has completed the TSCA certification on behalf of the importer, the importer must also provide FTN with written confirmation that the importer has authorized the shipper to complete the TSCA certification on its behalf. The importer may provide the confirmation in email on company letterhead.

ここに書かれている通り、第一義的には、書類の提出はBuyerの責任ということで、今回は、Buyerが以下のような書類を作ってFedExに送り、うまく通関にこぎつけたという結果になりました。
SDS(安全データシート)の提出が必要なケースに加え、化学品、特にインクや化粧品などをUSに輸出する場合は、TSCAフォームの提出が必要と理解しました。これ以外でも、石鹸、シャンプー、ペンキ、ワックス、パウダー などでも可能性があるようです。
